Acceptable use policy

This English version is provided for convenience. In the event of any discrepancy, the Spanish version shall prevail.

This policy sets out the rules for using the services of Archie Tech (hosting, email marketing, SMS, domains, development and automation), a brand of HC Venture Capital S.A.S.. It forms part of the Terms and conditions. Its purpose is to protect our clients, their users and the reputation of the infrastructure we share.

1. Prohibited uses

The services may not be used for:

• Illegal activities or activities that facilitate crime, including fraud, identity theft, scams and money laundering.
• Hosting or distributing malware, viruses, phishing, fake pages or tools to attack systems.
• Content that infringes copyright, trademarks or other third-party rights.
• Child sexual exploitation material or content that promotes violence, hatred or discrimination.
• Denial-of-service attacks, scanning other networks, unauthorised access attempts or cryptocurrency mining on plans that do not allow it.
• Selling, distributing or using databases obtained without the data subjects’ consent.

2. Email and SMS

• You may only send messages to people who have given you their consent. Sending to bought, rented or scraped lists is not allowed.
• Every message must clearly identify your company and include a simple way to unsubscribe or opt out, which must be honoured immediately.
• Marketing messages must respect the times and frequency allowed by Law 2300 of 2023 and the rules of the Colombian Communications Regulation Commission (CRC).
• Misleading subject lines or senders are not allowed, nor are messages impersonating financial institutions, government bodies or other companies.
• We monitor bounces, complaints and spam reports. If they exceed reasonable levels, we will pause sending and help you clean your list.

3. Fair use of resources

The resources of each hosting plan are designed for the normal use of websites, shops and applications. Hosting may not be used as storage for files or backups unrelated to the site, nor to run processes that consistently affect server performance for other clients.

4. Your account security

Use strong passwords, keep your applications and plugins up to date, and let us know if you detect unauthorised access. We may temporarily isolate a compromised site to protect the platform while it is cleaned.

5. Measures for breaches

If we detect a breach, depending on its seriousness we may: notify you so you can fix it, limit or pause the affected service, suspend the account or terminate the service without refunding the current period. Where required by law, we will inform the competent authorities.

6. Reports

To report spam, illegal content or misuse of our services, write to gerencia@archieagencia.com with any information you have (links, message headers, screenshots). We will review every report.
